Purpose and Extent of this Policy

Tankee Inc (“We”, “us”, “Tankee”) is committed to providing a mobile entertainment platform for children to watch the game videos they love, discover new games and more in a safer, more kid-friendly online environment.  As a parent or legal guardian (“You”) of a child user of the Tankee App (“Child”, “Children”, and collectively with You, “Users”) we to provide You and your Child with the important information below about how we collect, use, and share the personal information collected from our Users.  We also want to explain our parental consent practices with respect to information provided by you and your Child under the age of 13.  The App was designed to comply with the requirements of the Children’s Online Privacy Protection Act (“COPPA”).  For more information about COPPA and general tips about protecting children’s online privacy, please visit the Federal Trade Commission’s “Protecting Kids Online” website (https://www.consumer.ftc.gov/articles/0031-protecting-your-childs-privacy-online). Please note that the App is offered for use only by individuals who are residents of the United States.

 

Information We Collect

Information we collect from You during device activation

Whenever You activate the Tankee App on a device, we collect:

  • Your contact information, such as name, address, telephone number and email address;
  • Device information, such as hardware model, operating system version and unique device identifiers;
  • The username and password you select to enable Parental Portal; and
  • Any other information You may voluntarily provide us about your Child.

For children we know to be under the age of thirteen (13) years of age, activation is not completed until we obtain parental verification.  To obtain verification, we utilize the email address You provide in order to send the you a message that allows for parental verification of device activation. If you do not confirm the device activation within 7 days, we will delete your email address from our records.

 

Information we collect from Your Child during device activation

When a Child registers to use the Tankee App, we collect the following information:

  • Screen Name as chosen by the child user from a list of randomly generated choices;

  • Your Child’s birth date (for age verification) and first name (for use in the parental consent process); and

  • For a Child we understand to be age 13 or older, such Child’s name and email address.

  • Unless expressly disclosed at the time of collection, we do not collect other personally identifiable contact information from your Child.

 

Information automatically collected from all users

The Tankee App may collect this information whenever a User has activated the App:

  • Device information, such as hardware model, operating system version and unique device identifiers;

  • log information detailing how the App is used, the time spent watching a video, screens viewed, and actions taken within the App (including creation of Clips);

  • Search terms used within the App;

  • Favorite games and/or favorite gamers – the App may allow users to select these favorites; if a user does so, Tankee will collect that data; and

  • Timestamp of Sticker activity logs

 

How We Use Information We Collect

We will utilize the information that we collect about you or your child to:

  • Offer users personalized content based on their previous usage of the app and search terms the user has entered into the app;

  • Customize the content displayed when You or your Child use the App;

  • Prevent prohibited or illegal use of the app and to enforce the Terms of Service; and

  • For any other purposes disclosed to You or your Child at the time we collect the information or pursuant to your parental consent.

 

When We Share Collected Information

We may share information that is collected from you or your Child in the following circumstances:

  • Business partners – We share Aggregate Information about You and Your Child with our partners, service providers and other persons with whom we conduct business. We share this type of statistical data so that our partners can understand how and how often people use our Services and their services or websites, which facilitates improving both their services and how our Services interface with them. In addition, these third parties may share with us information about Users that they have independently developed or acquired;

  • Marketing and Advertising Partners – We share information about You and Your Child with trusted third-party marketing and advertising partners, unless you have requested that we not do so by opting out at the time of registration or later notifying us by email that you do not want us to share such personal information;

  • Changes to our Business – We may share information in connection with a substantial business transaction, such as a merger, acquisition or asset sale or if our assets are acquired by a third party in the unlikely event that we go out of business or enter bankruptcy; and

    Legal Requirements – We may disclose information about you or your child to government or law enforcement officials in response to subpoenas, court orders, legal process, law enforcement requests, legal claims or government inquiries, and to protect and defend the rights, interests, property, safety and security of Tankee Inc, our users, and the public.

 

Parental Access and Controls

We will obtain parental consent before collecting, using, or disclosing personal information from your Child under the age of 13.  Parents may contact us to ask if we have collected their Child’s user account information, to review that information, and to request that Tankee stop collecting this information and to have it deleted.  Such requests are subject to our verification through reasonable means that the requester is in fact the child’s parent.  Please send such requests to: help@tankee.com.

 

Protection of Information and Data Security

Tankee is committed to using all reasonable efforts to protect the integrity and security of You and your Child’s personal information.  We have adopted a variety of reasonable administrative, technical, and physical measures to help protect this information from loss, alteration, and misuse.  However, no data security precautions or systems can be guaranteed to be completely secure.  We cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our administrative, technical, or physical safeguards that are in place.

 

External Links and Third-Party Services

The Tankee App may include links that direct the user to a third party website or application, such as the Apple App Store or to an online retailer.  Parental approval is required in order for a user of the App to access such external links.  Tankee is not responsible for these third-party websites, companies or providers.  The existence of an external link within the Tankee App does not in any way infer that Tankee endorses or warrants the operator of the linked destination.  Use of the Tankee App may be subject to the terms and conditions and/or privacy policies of third-parties that Tankee does not control, such as mobile app stores, mobile software platforms or payment processors.  Please be aware that it is your responsibility to review the privacy policy of any such third-party.

 

COPPA Compliance

The Tankee App was developed in accordance with COPPA.  We do not knowingly collect personal information from children under the age of 13 in violation of COPPA.  In the event that a user identifies himself or herself as a child under the age of 13 through a question sent to Tankee or a support request, we will not collect, store or utilize in any way, and will delete in a secure manner, any personal information of such a user.

 

California Residents – Your California Privacy Rights

California’s “Shine the Light” law, codified as California Civil Code Section 1798.83, permits California residents to request the identity of any third parties to whom Tankee, Inc has disclosed personal information within the previous calendar year for the third parties’ direct marketing purposes, as well as the type of personal information disclosed.  You may make such a request by sending an email to help@tankee.com with “California Privacy Information Request” included in the subject line and body of your message. 

 

Additionally, California Business and Professions Code section 22581 permits California residents under age 18 who are registered users of online sites, services or applications to request and obtain removal of content or information they have publicly posted.  Such a request should be sent to help@tankee.com and include a detailed description of the specific content or information to be removed.  Please note that such a request does not guarantee complete removal of content or information posted online, and that the law may not permit or require removal of some or all such information in certain circumstances.

 

Changes and Updates to this Policy

Over time, it may be necessary to modify or supplement our Privacy Policy. When we make changes, we will post the changes to the Tankee website and change the date at the top of the policy. The amended Privacy Policy will be effective upon posting on the Tankee website. We encourage you to visit the Tankee website from time to time to review our Privacy Policy in the event it has changed. Your continued provision of information to us or use of the Tankee App following the posting of changes to the Privacy Policy means that you accept the changes and our use of your Personal Information in accordance with the revised Privacy Policy.

If we make any material changes to the Privacy Policy, we will use reasonable efforts to notify you of changes at least thirty (30) days before the effective date of the changes.  If you have provided us with your email address we will also notify you of material changes to this Privacy Policy by sending an email at least thirty (30) days before the effective date of the changes to the email address you most recently provided to us. We encourage you to keep the email address you provide to us current, and to promptly notify us of any changes to your email address, so that you may receive any notices we send to you regarding material changes to this Privacy Policy. If you do not agree to the changes, you should discontinue your use of the Tankee App prior to the time the modified privacy policy takes effect.
